Fighting for Free Speech Means Fighting for . . . Howard Stern

Legal rulings about indecency have a way of quickly slipping into ridiculousness, and so it is with the Federal Communications Commission’s recent decision imposing $495,000 in fines on Clear Channel for broadcasting an episode of the Howard Stern show. The F.C.C.’s opinion focuses on a program in which the self-proclaimed “King of All Media” interviewed the inventor of “Sphincterine,” which the commission huffily calls a “purported personal hygiene product.” A key factor in its analysis, duly noted in its “Notice of Apparent Liability for Forfeiture,” was that the segment contained “repeated flatulence sound effects.”

Call it the whoopee cushion doctrine. It is hard to believe that the government now regards flatulence jokes, the lamest staple of gag gift stores, as grounds for taking away a broadcast license. But since Janet Jackson’s unfortunate wardrobe malfunction, the F.C.C. has been furiously rewriting the rules. Another edict holds that broadcasters can lose their licenses even for “isolated or fleeting” swear words, a doctrine arising from a single gerund uttered at the 2003 Golden Globes.

Don’t bother calling the commissioners philistines � they do it themselves. In the Golden Globe ruling, they admit their definition could put D. H. Lawrence and James Joyce off limits. Not surprisingly, though, the F.C.C. has started with Mr. Stern. He has long been a favorite target; more than half of the $4.5 million in fines the F.C.C. has imposed since 1990 has been on him. The payments were once just overhead for his highly profitable show, but with the fines soaring, and broadcast licenses at far greater risk, the economics are dramatically changed. After the $495,000 fine, Clear Channel dropped Mr. Stern from its six stations. He remains on 35 other stations, but no one can say for how long.

It would be hard to quarrel with a broadcaster that dropped Mr. Stern on grounds of taste. Turn on his show or pick up his biography, “Private Parts,” and choose your reason, from his peculiar fascination with the sex lives of dwarves to his on-air interrogation of his mother about her sex life. But government fines, not high standards, spurred Clear Channel.

It is Mr. Stern’s offensiveness that makes his cause so important. The F.C.C. is using his unpopularity as cover for a whole new approach that throws out decades of free-speech law. The talk right now is over the colorful battles between Mr. Stern and Michael Powell, the head of the F.C.C. But when the headlines fade, the censorious new regime will apply to everyone. The danger it poses to the culture is real.

On March 18, the F.C.C. issued orders that spell out, as the commission puts it, “a new approach.” Some of the standards are objectionable on their face. The F.C.C.’s inclusion of “profanity,” which it concedes is often synonymous with “blasphemy,” means, a coalition of civil liberties groups, media organizations and artists points out, that “the most commonplace of divine imprecations, such as ‘Go to Hell’ or ‘God damn it,’ are now actionable.”

As disturbing as the new rules, however, is the F.C.C.’s warning that it does not intend to hold itself to any specific definitions of indecency. The commission states, at the end of a list of vague categories of forbidden speech, that it will “analyze other potentially profane words or phrases on a case-by-case basis.”

While making its criteria hopelessly vague, the F.C.C. is removing longstanding protections that give speakers breathing room. While the law has long said that violations must be “repeated” before a penalty can be imposed, the F.C.C. now says an isolated incident is enough. Instead of requiring that offenses be “willful,” the new rules hold that a broadcaster’s good-faith efforts to understand highly subjective standards are “irrelevant” to whether it will be punished.

This new legal landscape will stifle important artistic expression, since broadcasters will be afraid of wandering too close to an essentially undefined line. It also raises a real danger that indecency will be used to stifle political dissent. Among the comments Mr. Stern is in trouble for are a schoolyard epithet used about President Bush and another aimed at a Republican congresswoman.

The combination of unknowable rules and draconian penalties is already having a chilling effect. There are reports of radio stations banning classic songs like Lou Reed’s “Walk on the Wild Side” and Elton John’s “The Bitch is Back.” The television show “ER” recently edited out a brief shot of the exposed breast of an 80-year-old hospital patient. And the satirist Sandra Tsing Loh was fired by a public radio station when an engineer failed to bleep out various words that were meant to be bleeped for comic effect.

Even Mr. Stern has been transformed by recent events. He now regularly talks about the F.C.C. on his show, and his Web site has a quotation from Supreme Court Justice William Brennan, discussions of the presidential election and voter registration information. More uplifting content than usual, but it is taking Mr. Stern’s time and energy away from sphincters, flatulence and all the other vulgarities he has a constitutional right to obsess about.

its a beautiful morning in hollywood.

its always beautiful when you get to wake up with a pretty girl who goes down on you, lets you flip her over, and like wise you roll off the bed and act like animals as liz phair plays and the sun shines and the ceiling fan twirls and the sheets tangle and the birds chirp.

no way do i want to go to work today. no way is that girl topless right now pulling on her jeans and buckling her trendy white belt. no way will i be working for the xbi in two to three months.

i had a great long weekend. on thursday i got to teach at the greatest classroom in america. on friday i saw the pixies and had my mind blown. on saturday a gorgeous young woman made me a madras and sprinkled some ecstasy in there and i told her that i was feeling sick and she told me what it was and i was all, you….. and i smiled and she said what can i get you and i said just give me a second to shower and right there in the shower it came on and we walked to the grocery store for eight cans of whipped cream gummy bears and popscicles. we only remembered the nitrous. on sunday she left me a worn out mess flopped on the couch barely able to nibble on the french bread from the day before and drinking warm orange juice because it was so hot in hollywood this weekend that everything ended up being warm.

and here i am waiting for her to curl her hair and drive me to work so i can get yelled at for not being the perfect xbi agent that i never was. calgon has taken me away but reality has brought me back and im stronger and happier and better prepared for my departure from this stage of my so called life.

i am seriously as in seriously as in super seriously considering quitting this job and doing that photography experiment where i have a chair on hollywood blvd and a table that has a sign in book and a sign that says no talking and another sign that says smile and a bucket where people will give me $2-$20 depending on how im doing that day.

the xbi’s base salary is $25k because they know that we shake down all of the criminals that we catch. most agents make over $100k. because i have a “technical” position of flying chopper one, my base is $30k and i give everything that i shake down to the united negro college fund.

and i live fine.

$30k a day after taxes is $100 a day. which is 30 people saying yes i will let you take my picture here on hollywood blvd in hopes that it might make it into a tony pierce photo essay coffee table book and tipping me $3. thirty people a day on hollywood blvd. i think it can be done. call me crazy but i think it will be fun and easy. call me nuts but i think a tourist family of four would give me $10. call me nuts but i think a couple would give me $5. call me insane but if i got 5 families (5×10) 4 couples (4×5) and 7 randoms (6×3), i would make as much as i do now and it would be creative and fun and interesting.

of course it would also be dangerous since hollywood blvd isnt the safest place and i would have a $1000 camera and maybe maybe maybe a $250 photo printer so that these people would have something to take back home of their trip to hollywood california. and it will be annoying trying to convince all the hobos and crackheads that i cant speak (pointing at a sign that says No talking doesnt mean much when the urchin cant read).

and maybe after 100 pictures i can get a book deal. although i doubt it.

and maybe after 50 picures of celebrities i can sell some to whoever you sell those to, but i doubt that too.

and of course there will be a website called smilenotalking.com where people can set up appointments to get to meet the barely famous blogger who seriously lost his mind when he gave up his career of 3 years and traded in sure money and medical benefits in the name of art.

but you cant always sit around waiting for the man.

the job of a reporter is to go places that not everyone can go to and tell the story of what went down.

normally you shouldnt be jealous of the reporter.

but you will be jealous of this reporter and you should be jealous and its not normal but theres nothing normal about the pixies.

formed in boston but broke through in england the pixies were the overlooked gems during the grunge goldrush of the late eighties early nineties.

i first saw them on the janes addiction ritual de habitual tour at san jose state 1990. the lineup was primus the pixies and janes. then later in 90 at the ventura theatre. i remembered that they just sorta stood there and shoegazed like how many of their 4ad labelmates did at the time.

and even though they were making some of the most powerful and beautiful music of the time they did not sell very well, their videos werent on mtv, and you only heard “here comes your man” on the radio occassionally. this was at a time when pearl jam, stone temple pilots, soundgarden, nirvana, hole, and jane’s “been caught stealing” was on heavy rotation – even on the rock stations.

the problem was the pixies were too good. they actually had interesting lyrics, dynamics, intracacies, delicacies that the sledge hammer of grunge deafened everyone to.

primus’s “winonas big brown beaver” was better received than anything the pixies ever did.

and when they broke up there wasnt any public outcry, and when bassist kim deal’s second record with the breeders came out, nobody expected it to go platinum. but it did. and more people bought “cannonball” than all the pixies records combined. and when black francis changed his name to frank black and went solo, who would have thought that the voice of the pixies wouldnta sold as much as the blushing chain smokin feminine side of the group, and dare i say the unlikely sex symbol. but she is. i love her. i want her. and i dont know too many people who dont.

with that said the pixies returned to southern california today in a double secret undercover show. not even the glass house in pomona where they were playing would own up to it the day of the show.

when i called them to find out what the lineup was they said its just a party. when i called up to ask what time the first band would start they said 7. when i called up to ask what time the pixies would play they said 10:30. when i called back to ask how many bands were playing they said you must have the wrong number this is the glass house.

we got there at 8:30, my true love and i. pomona is only about 45 minutes from hollywood but there was a lot of traffic on the 10 east. 100,000 people were going to coachella to see 50 bands including radiohead, kraftwork, beck, the cure, bright eyes, the flaming lips, death cab, stereolab, and they will know us by the trail of the dead, international noise conspiracy, thelonious monster, air, the evens, belle & sebastian, the crystal method, pretty girls make graves, phantom planet, danger mouse, and kate sullivans second favorite band junior senior.

but the only band that most people really wanted to see out in the desert were playing a warmup secret show at a small club. tickets were $30.

the only “proof” i had was the word of a coworker who told me that his friend told her about it. i said so. then she showed me a picture of this guy hugging paris hilton.

i said so.

still i bought the tickets, even though tickets after ticketmaster monopolied my ass were $94 for a pair. how could i have a chance to see this band and miss it?

my true love drove, we saw all the punk rock kids gathering around the doors, waiting for their miracle ticket that never came.

the pixies got on stage at around 9:45p and it was like the best suprise party in the world. the glasshouse had been sold out but it wasnt oversold. everyone had digital cameras except me. one guy even had a hand held flash. it was 18 and over. no beer was sold on the premises. we parked for free in a public lot three blocks away. the crowd was half college kids, half college grads of 91.

there were pixies concert tshirts for sale for $20. april 29th isnt on the shirt.

reportedly jack black, juliette lewis, and harr marr superstar were in attendence. but the best people in attendence were the pixies. the class of 91. overlooked because they didnt dress funny or kill themselves or make kickass videos. overlooked because of the subtlety to their rock. and the power to their pop.

just like the mysterious popularity during the comeback and return of weezer, there is this, the return of the pixies who sing as beautifully live as they do on record. who play like grownups on stage even when theyre spitting out their camel lights in time to join a chorus.

the pixies have made a glorious and heartwarming comeback despite not having a new song, a new album, or a new video.

the news is that theyre back, and thats reason enough to celebrate.

and unlike this beautiful encore, tonight there was none.

im still in a hazy fog of happiness.

i was invited to return back to the greatest classroom ever and sit at the head of the table and teach. later i was asked by someone what i taught, what the book was about, what were the themes.

and i said the book was about sex drugs and rock n roll.

a few of my closest friends were there, my favorite teacher was there, the class was packed, nearly everyone had read the book and were giving their two cents. it was super nice.

they told me the terrible news that the college paper, the daily nexus wasnt good anymore, and right away i told them that that only means that they should write for it.

i told them that since the college of creative studies doesnt have any grades or tests or finals, i started writing at the nexus to not only practice writing, but to get paid to practice, and that nothing was better than having 10,000+ people read your shit every day.

i didnt say shit.

afterwards i gave my teacher a copy of Blook, which i had saved for her for over a year and a half now. then we walked to isla vista and had pizza at woodstocks. and it was delicious.

not only did she tell me that i did a good job, and that aj and i worked together very well in the class, but that i should get a masters in creative writing and persue teaching college. a million people have told me that, but when she said it i said ok. she never lead me into a bad thing. although at the top of her list of recommendations, above princeton, stanford, and cal arts, she kept talking about uc irvine.

i was thinking, i dont wanna be an anteater.

then she went home and our little happy group of close friends began drinking, eating, and then someone slipped something in our drinks which made us very fond of one another, and we sat infront of the biggest fireplace that ive ever seen and listened to jeanine serenade us on guitar, a piano was played, aj spun the most wonderful curtis mayfield slowjams and this morning i woke up

heres what i think i love about the basketball diaries by jim carroll, the diary of a rich white bisexual teenage basketball player who ends up being a heroin addict before he turns sixteen.

it shows you that the great american novel doesnt necessarily have to be a novel.

it shows you that your diary entries can be short and sweet and turn into a movie starring leo dicaprio and marky mark.

it reminds you that if you just tell the story you dont have to worry about anything else.

im not exactly sure that it was really written when he was 14 15 and 16 because if it was then its the greatest teenage writing since anne frank.

in real life jen is married to the most handsome actor in the world and she cant get knocked up. in real life chandler is addicted to pills and monica has an eating disorder and is married to a freak.

think any of those real issues that many people can relate to find their way into the show somehow? of course not. that would involve even a whisp of risk. the jokes might not come as easy, but big deal, there was very little that was truly funny about the show in the first place, so go for it.

if you ask me david arquette is one of the funniest people out there. why wasnt he on the show, and dont tell me its cuz he had a huge career going cuz he never had a huge career going. let him date monica on the show. duh. let him be the coked out freakazoid that he is in real life and then you’ll have a little edge to your perfect little hallmark card of a programme.

in a very special friends have chandler risk his entire career because of the legal pills that he became addicted to. if america loves the friends as much as they seem to let the boy act for once in his worthless life and release the pain he must have gone through as he found himself spinning out of control, only to be saved by one of the most beautiful black women in all of entertainment who will become his girlfriend in rehab: lil kim.

instead friends gave you aisha tyler. who is funny. who is beautiful. but is unlike any black woman that youve ever seen in your life as shes constantly smiling, incredibly approachable, perfectly harmless, and although darkskinned as safe a pick for a “black” character as nbc could have found.

lil kim however is her own woman has her own style and is far more new york than anything one would find in the central perk.

in an era where america has shown that they want reality shows, it is not suprising that friends, the most unrealistic top rated show since leave it to beaver (which had more edge) is now calling it quits.

my only plea is that they get on with it already and die.

and now i have to finish my homework like a good boy so i can teach this bitch on thursday and i cant wait. and my reward is that if i can do it tonight i can sleep in santa barbara tomorrow, eat a burrito in iv on thursday and see the pixies on friday. and if im really luck i can makeout with that cuban chica on saturday.

i hate tuesdays.

i hate wednesdays. i hate mondays. im screwed. tuesdays we have our weekly meetings. typically they tell us how much chopper one has cost the agency and i have to defend it by saying how much money it has brought in. but not everything is that clear cut.

if someone says theres something going down in the lbc and we need chopper one for cover and if we dont get anything out of it then am i to blame? every meeting i want to say, its a black helicopter, it cant be seen on radar. the surveillance and intimidation and backup are priceless. but i cant because then everyones feelings will get hurt and people will start fighting and when we start fighting at work the guns get pulled and sometimes so do the triggers.

needless to say id much rather be flying around than being in a meeting. theres money to be made outside. i know we need our meetings but they could be done during lunch on fridays and it wouldnt bite into moneymaking time and people would chill the fuck out.

hot as fuck this morning. i got off the subway at wilshire and western and there were i swear 40 kids lined up for tonights morrissey show. most the kids had chairs or stools or sleeping bags or something. theyd been out there on the filthy sidewalk since last night. these are kids too young to ever have seen morrissey sing with the smiths. blows my mind. and its hot. and the scum of the earth walk around that corner sparechanging like a bitch.

i dont see him doing duet records or unplugged records or full soundtracks or even reunion tours. fucker just keeps on keeping on.

but the best news this morning was that howard stern got his ratings for march and he was up in new york chicago and la. but in san diego where he was dropped by clear channel, the station’s morning numbers plummeted from a 20 to a 0.6 in the prime demo of 18-34.
